What is the Process for a Workers’ Compensation Case in Macon?

Published in Workers Compensation on June 4, 2019.

Injuries sustained while a worker is on the job can be sudden and painful. Fortunately, there is a mechanism in place by which injured workers can pursue compensation for those injuries from their employers. This process is known as workers’ compensation. When you are injured on the job, workers’ compensation could act as your safety net, allowing you to continue caring for your loved ones as well as yourself.

Workers’ compensation benefits are twofold. First of all, these benefits cover your lost wages and your medical expenses during the time it takes you to recover from your on-the-job injury. Secondly, these benefits compensate you for permanent and temporary disabilities that you incur as a result of being injured in your accident.

In order to obtain and take advantage of workers’ compensation benefits, as with all types of insurance coverage, there are certain protocols and procedures which you must follow. When it comes to recovering workers compensation benefits, the experienced Macon workers’ compensation attorneys at Nelson & Smith Attorneys at Law could assist you with your legal matter. Our knowledgeable lawyers represent accident and work injury victims in and around Macon, Dublin, and Tifton, Georgia.

Qualifying for Workers’ Compensation Benefits

First and foremost, workers’ compensation is a type of insurance. Workers who suffer injuries while they are on the job (and while working within the scope of their employment) are eligible to file for these benefits. In Georgia, the State Board of Workers’ Compensation (SBWC) oversees these claims and their resolutions. If you do not satisfy the requirements for recovering benefits – or if you are an independent contractor, rather than an employee – then the Board could deny your claim.

Steps to Recovering Workers’ Compensation Benefits

In order to recover benefits for injuries you sustained while on the job, there are three things which you should always do:

  • Immediately report your injury and what happened to your immediate supervisor on the job
  • Obtain medical care and treatment for your injuries as soon as you possibly can
  • Follow all of your medical doctor’s treating recommendations

Employers are required to post a list of medical providers that employees can choose to treat with after they sustain their on-the-job injury. In most scenarios, you are not allowed to choose a health care provider outside of this panel for your medical treatment.

After you have finished your medical treatment, another health care provider might be able to offer an opinion as to permanency. In that instance, you may be eligible to pursue benefits for your permanent injury or medical condition.
